No Safe Haven for Terror Sponsors

Foreign governments are acting against Australians right here on our soil—and that’s why One Nation support the Criminal Code Amendment (State Sponsors of Terrorism) Bill 2025. This bill finally allows foreign states and their agents to be listed as terrorist organisations when they plan, assist, or advocate attacks against Australia. It’s about protecting Australians from intimidation, bullying, and terrorism.

The bill also creates new offences to stop anyone helping these entities, while allowing legitimate engagement where required. Yes, the reversal of the onus of proof is serious, and we’ll keep scrutinising it—but in this case, it’s justified to prevent deadly acts of terrorism. Australians of all backgrounds deserve protection.

One Nation backs this bill because every Australian deserves protection from terrorism and foreign coercion.

One Nation has called out foreign governments and their agents who act against Australian citizens and even against our country right here in Australia. These include China, some Islamic nations and some members of the former Soviet Union. The Criminal Code Amendment (State Sponsors of Terrorism) Bill 2025 would amend the Criminal Code to enable listing of certain foreign states or foreign state entities as terrorist organisations. Currently, this is not possible with the law, because foreign states or foreign state entities are not able to be listed as terrorist organisations. Two lawyers, including a barrister, and their staff have scrutinised this bill for One Nation, and our senators have considered and discussed the bill. The bill would authorise the Governor-General to list in a regulation foreign state entities as state sponsors of terrorism. That’s wonderful. The precondition to this occurring is that the minister for the Australian Federal Police, who is the home affairs minister, must believe on reasonable grounds that the foreign state or entity has engaged in, prepared or planned, assisted or fostered the doing of a terrorist act targeted against Australia or, in addition, if the entity has advocated doing a terrorist act that was targeted at Australia. The minister can only act with the agreement of the foreign affairs minister. 

Secondly, the bill creates new offences which would criminalise conduct in which these entities engage and criminalise the conduct of persons who would seek to assist or support these activities. Additionally, it provides for appropriate defences for people who the law requires, for example, to engage with a listed entity or engage with an entity for a legitimate purpose. One aspect that has raised some concerns, though, is the reversal of the onus of proof that will apply when some defendants raise certain defences, where the defendant must establish the defence on the balance of probabilities. For example, a defendant may have the onus of establishing that they took all reasonable steps to disassociate themselves from a particular terrorist entity. The reversal of the onus of proof is a major event in legislation and should not be done lightly. Nonetheless, it appears justified here because of the nature of the offending behaviour. 

We in One Nation have noticed this increasing trend in Labor-sponsored legislation over the last few years, and that sounds alarm bells to those who are responsible for scrutinising good policy. We’re very concerned about this trend. At times, this is a precursor to control and may reflect today’s Labor’s propensity to control. This reversal of the onus of proof must be carefully scrutinised on each occasion on which it’s raised. On this occasion, the government has justified this approach because of the preventive nature of measures that are being enabled to protect the Australian community from targeted acts of terrorism and the high risks of death or injury associated with such acts of terrorism. This bill’s additional protections are reasonable in the overall circumstances, given that radicalised Islamic extremists perpetrate relatively frequent terror attacks and Chinese Communist Party agents intimidate and bully law-abiding Australian citizens of Chinese dissent here in Australia. One Nation believes that Australian citizens of all backgrounds must be protected. We support this bill.

Israel Capital – Just a political decision?

The Albanese Government’s decision to overturn recognition of Jerusalem as the Capital of Israel doesn’t make sense. It appears to be a political decision to appease the radical Labor left.

One Nation considers it the responsibility of the Israeli government to decide the location of Israel’s capital city, not the Australian government. Israel selected Jerusalem. One Nation approved the former government’s recognition of this fact and the decision to relocate Australia’s embassy there. The Albanese government’s decision is like Germany declaring Brisbane or Perth the capital of Australia instead of Canberra. It’s confusing and clumsy. We’re critical of the government’s decision to switch Australia’s embassy in Israel back to Tel Aviv. Is this an entirely political decision to pacify Labor’s radical left and gain Muslim votes in the coming Victorian election? Proscribed terrorist organisations like Hamas have already praised the government for this decision to change recognition of the Israeli capital. That the Israeli government was not even informed ahead of time is further indictment of the Albanese government’s decision. One Nation considers the decision to be the Prime Minister’s clumsy mistake and calls on him to reverse it and again recognise Jerusalem as Israel’s capital.

Weak Joe Biden leads to more conflict in the world

We are seeing more conflicts across the world, from Gaza to Mexico to China, because enemies feel more emboldened when there is weak leadership in the United States. They know they can push the boundaries more than they could before.

Expect to see more of it under a Biden administration. I hold grave concerns with how far China will push the boundaries to take advantage of the weak leadership in the US.

I mean, look Malcolm Roberts we’re not going to spend the whole hour talking about Israel, but it’s awful with dozens of people on both sides of the border. When it comes to that Gaza strip aggression into even downtown Jerusalem, they have this Iron Dome of protection, missiles that basically blow up missiles out of the ground… out of the sky.

You know that this is ugly, but Israel is a democracy. Israel is the only democracy in the whole of the Middle East. Israel is worthy of defending. But equally the Palestinian claim on the territory is worth, you know, discussing but surely there’s room for both to live peacefully? If only they’ll give peace a chance.

[Malcolm Roberts] Yes. That’s the first thought that came to my mind when you raise this topic, Israel is indeed the only democracy in the middle East and it needs to stay. And then the Palestinians also have a right to exist. So I don’t think that’s, disputed by sensible people but what you do see when leadership fails, then you start seeing ill discipline coming in and aggression coming because they know there’s less-

[Malcolm Roberts] -possibility of a consequence. And look at, look at the Mexican border. Now with the United States people pouring through. Texas now suing. So I read somewhere, Texas suing the Biden administration for being Lax on the border. I mean, it’s all going to custard and what worries me is what the Chinese will do with regard to Taiwan and what the Chinese might do with regard to us when they see a very weak leadership in the what is supposed to be the biggest and most powerful democracy that’s ever existed.

And it’s crumbling, we can see that the United States has really gone South. Thanks to Bill Clinton. Thanks to Barack Obama in particular. There was hope when Reagan was in and there was a lot of hope when Trump was in, but the globalists have taken over and they’re gutting that country. And so we’ll see all the tyrants and the and the despots taking over and playing the games that they can get away with now.

[Gary Hardgrave] Yeah, I think really what’s going on. And it’s awful. As I said, innocent children being killed. Conflict that doesn’t need to be there, is occurring. There is room for everybody to live peacefully. Side-by-side different religions. As I said, Holy land for Jews, for Christians, for Muslims for the Abrahamic faith. Everyone. The people of the book.

And the good sensible Muslims I know, passionate about Palestine understand that, respect that but they also understand that there’s a lot more in common with Jews and Christians, than these sorts of crazy extremists are promoting.
