This time it is for the blatant contradiction between their own statements and the Ombudsman's findings.
I pushed Mr Furlong to reaffirm that enterprise agreements cannot legally undercut award entitlements, then confronted him with written evidence from the Ombudsman claiming the exact opposite: that an enterprise agreement "overrides" the Black Coal Award.
I pressed further, pointing to the Penny Vickers case to show this pattern isn't new. Unions and big businesses have used enterprise agreements to "legalise" underpayment before, and only whistleblowers exposed it.
Despite every attempt to deflect, the failure is undeniable. The Fair Work system has allowed wage theft before, it's allowing it again, and regulators refuse to confront it.
I won't let them hide behind the process.
The public deserves clear answers when there appears to be a contradiction between official statements and findings.

You realize significant legislative updates took effect from the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 since then? Under Australian workplace law, an approved enterprise agreement (EA) legally operates to the exclusion of ("overrides") the underlying modern award, including the Black Coal Mining Industry Award. This means that once an EA is approved by the Fair Work Commission (FWC), the employee's specific day-to-day terms, entitlements, and working structures come directly from that agreement rather than the award An enterprise agreement can over ride entitlements but cannot simply strip away entitlements. Before approving an EA, the FWC applies the Better Off Overall Test (BOOT). This requires that each covered employee (or prospective employee) must be better off overall under the proposed agreement than they would be under the underpinning award. Because the BOOT evaluates the entire package globally, an EA can modify or remove specific award provisions (like specific penalty structures) if it offsets them with superior benefits elsewhere (such as higher flat or "loaded" hourly rates). While this was introduced by a Labor government, it was solidified by Fraser’s Liberal government in 1978. So Nyadol Nuyon’s stance reflects a position Australia has held for almost 30 years. Why is it an issue now? Furthermore, if we were to return to assimilation ( through legal processes, not ignorant outrage on social media) what culture would we assimilate to, after 30 years of multiculturalism?
I heard she was going through the process of renouncing Her citizenship, before returning to Sudan. Why can't she return while the process is in motion . For a lawyer surely it's not a complicated process, basically fill out a form and lodge it online.
